Coroner’s Inquest into the Death of Jermaine Carby

Faisal Mirza represented the family of Jermaine Carby at a Coroner’s Inquest from May 9 to 23, 2016.  Mr. Carby was shot to death by Peel Police officers on September 24, 2014

During cross examination of key civilian witnesses and police officers involved in shooting Mr. Carby, the circumstances of Mr. Carby’s death were revealed.

Mr. Carby was subject to a “street check” for no lawful reason despite the fact he was a passenger in a vehicle during a traffic stop.  The role of “street checks” aka carding in policing was scrutinized at the hearing.  Expert evidence was called to show the disproportionate affect of carding on the black population.   Also, police use of force practices towards the mentally ill were reviewed exposing that police trainers have not implemented recommendations for change made by previous inquest juries and government commissioned studies.

The jury ruled the death to be a homicide and made the following recommendations.  It is hoped that the government and policing trainers will seek to implement them immediately.
